Court dismisses suit challenging domestic spying

washington (cnn) -- federal appeals court friday ordered dismissal of aclu lawsuit challenging president bush's domestic surveillance program.

plaintiffs -- group of journalists, scholars , legal advocates -- had no legal standing pursue claims because not show targeted national security agency's warrantless spying program, court decided in 2-1 vote.

"they cannot establish 'aggrieved persons,'" wrote judge alice batchelder, of 6th u.s. circuit court of appeals in cincinnati.

aclu argued in legal tightrope, trying prove members being spied on without access electronic records support claim.

court ordered federal judge in detroit formally dismiss lawsuit, filed in january 2006. first appeals ruling address program. ruling did not address larger constitutional questions of whether nsa program legal, or limits on permissible warrantless surveillance.

administration secretly instituted program after september 11, 2001, attacks on new york , washington. gives nsa authorization conduct wiretaps without court order.

judge anna diggs taylor struck down program last august, saying violated rights free speech , privacy under first , fourth amendments. said violated foreign intelligence surveillance act, or fisa, congress passed in 1978.

6th circuit allowed program continue, giving government time appeal. appeals court's ruling allows nsa continue activities, including monitoring americans' phone calls , e-mails without warrants.
